Navigating workplace benefits is crucial for both employers and employees in the UAE, and understanding sick leave rights is an essential part of this. UAE labor law outlines clear rules regarding sick leave, ensuring that employees are protected while maintaining a fair system for employers.
Eligibility for Sick Leave
Employees in the UAE become eligible for paid sick leave after completing their probation period as stated on their labour contract with their employer. *Note that a probation period cannot exceed 6 months.
Duration and Pay
Once eligible, employees are entitled to up to 90 days of sick leave per year. Sick leave is divided into three parts according to UAE labor law:
- First 15 days: Full pay
- Next 30 days: Half pay
- Remaining 45 days: Unpaid
Employees are expected to follow this schedule, and employers cannot require work during approved sick leave.
Requirement for a Medical Certificate
To qualify for paid sick leave, employees must provide a medical certificate issued by a licensed doctor. The certificate should clearly state the nature of the illness and the expected duration of absence. Failure to submit a valid medical certificate may result in the leave being treated as unpaid or unauthorized.
The cost of a sick leave certificate or medical report in the UAE can vary depending on where and how it is obtained:
▪️Dubai Health Authority (DHA) sick leave certificates: Certain certificates are available free of charge, but attested certificates (officially recognised for employment purposes) can cost around AED 70 for issuance.
▪️Ministry of Health and Prevention (MOHAP) attestation: For attestation of medical reports issued by private or government facilities, a fee of around AED 50 may apply.
▪️Clinics and hospitals: Private clinics often charge for consultation and issuing a sick note; common out‑of‑pocket costs (including consultation + certificate) in practice may range from approximately AED 50–100 or more, depending on the provider and insurance coverage.
Note: These are typical fees seen in practice; actual charges may vary by emirate, facility, and insurance plan.
Attestation for Extended Sick Leave
If sick leave exceeds a certain number of days (often more than five days), the medical certificate may need to be attested or approved electronically through health authorities such as MOHAP or the relevant emirate authority. This process may involve additional fees and administrative steps.
Additional Considerations
▪️Sick leave is cumulative within the calendar year and does not carry over.
▪️Employers should maintain clear records of all sick leave taken.
▪️In cases of chronic illness or extended medical treatment, special arrangements should be discussed between employer and employee.
Understanding these entitlements ensures that employees receive their legal benefits while helping employers maintain a structured and fair approach to workforce management.
